Terms and Conditions

These general terms and conditions apply to all on-site and online poker events organized under the Benelux Online Super Series — hereinafter referred to as “BOSS” — as well as to the use of the BOSS Orbit, the digital channel on the Days of Poker platform.

1. What Are the Benelux Online Super Series?

The Benelux Online Super Series are organized and offered by Pokahnights VZW, with its registered office in Belgium, Boomsesteenweg 440, 2610 Antwerp, registered with the Crossroads Bank for Enterprises under number 0654.774.744, owns and organizes the Benelux Online Super Series — hereinafter “BOSS”.

The physical events take place at licensed live poker venues (“Live Poker Venues” or “Clubs”) that hold the required authorizations and operate under the supervision of the competent regulatory authorities. For the online events, BOSS collaborates with technical and regulated gambling service providers that hold a valid Belgian license. These partners provide their platforms to host and manage the online gaming components in full compliance with Belgian gambling legislation. BOSS does not itself operate any gambling services, but offers a competitive framework within which recognized partners organize poker activities in accordance with legal provisions.

The terms “BOSS”, “we”, “us”, or “our” in these Terms and Conditions refer to Pokahnights VZW.

2. Thank You for Participating in BOSS Events

These Terms and Conditions for participants in the BOSS events (“Terms”) constitute a binding agreement between you and BOSS. They apply to your participation in both online and offline events, as well as to your use of the BOSS Orbit, the digital channel of the Benelux Online Super Series on the Days of Poker platform.

3. About Participating in BOSS Events

BOSS events and related communications take place both physically and digitally.

3.1 Physical – In Licensed Live Poker Venues or Clubs

BOSS events take place physically in licensed live poker venues (“Live Poker Venues” or “Clubs”) that operate in accordance with applicable Belgian regulations and under the supervision of the competent authorities. These venues provide their infrastructure, staff, and — where applicable — necessary permits for the organization of live poker activities within the BOSS framework, in line with legal requirements. BOSS is not a promoter of these venues and does not act as a communication channel on their behalf.

3.2 Digital – Through Regulated Online Gambling Operators

BOSS events may take place digitally through a licensed and recognized online gambling operator, as defined by Belgian legislation. We only collaborate with technical partners holding a valid license, in full compliance with the rules imposed by the Belgian Gaming Commission and the applicable legal framework governing online gambling in Belgium. These partners provide their platforms for the technical execution of BOSS events. BOSS is not a promoter of these operators and does not act as a communication or marketing channel for them. The specific conditions that apply to participation through such a platform are determined by the operator itself.

3.3 Digitally via the BOSS Orbit

Information about BOSS events is also shared digitally via the BOSS Orbit on Days of Poker. The terms of membership to the BOSS Orbit on Days of Poker are outlined in this document.

4. General Rules

BOSS provides an organizational and sports-oriented framework for experiencing poker in a transparent, structured, and legally compliant manner. BOSS does not organize poker activities itself but works exclusively with recognized and regulated partners — both physically (live venues or clubs) and digitally (technical providers of online gambling services). Operational execution, data processing, infrastructure, and oversight fall under the responsibility of these partners, each within their respective domain and in accordance with their legal obligations.

BOSS accepts no liability for technical malfunctions, service interruptions, or unauthorized use of data resulting from the use of the physical or digital infrastructure of these partners. By participating in a BOSS event or by engaging with the Orbit channel, you agree to indemnify BOSS against any claims or damages beyond its coordinating role.

Anyone participating in BOSS events (both online and offline) or following the BOSS Orbit must always communicate in a respectful, appropriate, and civil manner — whether in person, through the chat function, or via any other interactive component of the platform.

The following behaviors are strictly prohibited:

  • Using offensive, abusive, or discriminatory language;

  • Threatening, intimidating, or mocking other members;

  • Inciting hatred, violence, or any form of extremism, regardless of context;

  • Sending sexually explicit, racist, xenophobic, or otherwise inappropriate messages;

  • Spreading spam, advertisements, or other unsolicited messages.

BOSS reserves the right to take immediate action against any communication that violates these guidelines, including — but not limited to — temporary or permanent suspension of participation in the case of repeated or serious infractions.

BOSS also reserves the right to remove any messages that breach these guidelines without prior warning and to suspend accounts temporarily or permanently in case of repeated or serious violations.

Members who witness such behavior are strongly encouraged to report it immediately to the organizers or moderators.

4.1 Data Processing & Privacy

In the context of participating in BOSS events, using the Orbit channel, or related administrative processes, certain personal data may be shared and processed. This occurs exclusively:

  • when required by law (e.g. for verification or reporting purposes);

  • or when necessary for the practical execution of the event or for administrative simplification.

In this context, data may be shared with our live or online partners — these are exclusively recognized and regulated entities operating under the supervision of the competent authorities. No personal data is shared for commercial, promotional, or marketing purposes. All processing is carried out in accordance with applicable data protection legislation. You can find all relevant details in our separate Privacy Policy.

By participating in our online and offline activities and becoming a member of the Orbit on Days of Poker, you consent to this processing as described therein.

We strongly recommend that you read the Privacy Policy carefully — also available in the “documents” section — to understand which data we collect, why we do so, and how we protect it.

4.2 Intellectual Property

All on-site and digital elements — including but not limited to software, photographs, designs, illustrations, artwork, videos, music, sounds, coding, graphics, technologies, processes, text, interfaces, interactive elements, methodologies, names, logos, and trademarks — are the exclusive property of Pokahnights or its licensors. Unauthorized use is strictly prohibited.

4.3 Photography and Video Footage

During live events, photographs and video recordings may be taken at the licensed live poker venues (“Live Poker Venues” or “Clubs”) for purposes of reporting, promotion, and community engagement. This visual material may be shared through Pokahnights’ digital channels, such as the website, social media, the BOSS or Pokahnights Orbit, or other communication platforms.

Participation in certain events implies consent for the use of such media. For larger events — such as finals, big-ticket events, and series — audiovisual content will be recorded, and you will be informed in advance or on-site.

For specific campaigns, such as BOSS events, taking an official photograph is part of the participation conditions. Only players who consent to this are eligible for titles and corresponding payouts. This is essential for the credibility, visibility, and promotional value of the championship.

By participating in our events, you accept these terms and give your consent for the use of image material unless expressly stated or agreed otherwise.

4.4 Liability, Indemnification, Security Cameras

BOSS accepts no responsibility for malfunctions, service interruptions, or unauthorized use of data. You agree to indemnify BOSS against any claims or damages arising from your use of the poker room. BOSS is not liable for any accidents or theft.

At certain physical locations where BOSS events are held, camera surveillance systems may be in operation. These systems are managed by the venue operator in compliance with applicable privacy and surveillance legislation, and serve the following purposes:

  • ensuring the safety of participants and staff;

  • monitoring the integrity of the gaming infrastructure;

  • detecting potential fraud or incidents.

Information about camera surveillance is available on-site or upon request from the respective venue operator.

4.5 Corrections in the Event of Administrative Errors

BOSS strives to organize all poker activities with accuracy. In the event of an administrative error during registration or the execution of a tournament — including, but not limited to, incorrect processing of tickets, bounties, prize money, registration fees, or payout structures — BOSS reserves the right to take corrective measures once the error is identified. These measures may include:

  • correcting tickets or payouts;

  • issuing additional payment for underpaid prize money;

  • recovering prize money paid in excess.

BOSS will make reasonable efforts to notify affected players as soon as possible. Players acknowledge and accept that they are required to return any funds received in error upon simple request.

BOSS’s liability is limited to the correct execution of the tournament format as intended at the start of the event. BOSS is not liable for indirect, consequential, or immaterial damages. By participating in an event, players accept these terms.

 

4.6 Proper conduct, loyalty and protection of reputation

Participants in BOSS events, whether online or offline, users of the BOSS Orbit, and recipients of prizes or benefits within the framework of BOSS, undertake to act in a loyal, proper and respectful manner towards:

  • Pokahnights VZW and the Benelux Online Super Series (BOSS);

  • its events, formats and organisation;

  • its partners, including but not limited to live poker venues, technical providers of online games of chance and/or Days of Poker;

  • other participants, staff members and stakeholders.

It is not permitted, either during or after participation in BOSS events, to make public statements (including but not limited to via social media, forums, review platforms, livestreams, interviews or any other online or offline channels) that:

  • disseminate manifestly incorrect, misleading or defamatory information;

  • are likely to seriously harm the reputation, credibility or commercial interests of BOSS, its partners or its events;

  • constitute deliberately negative or harmful communication that is disproportionate to the actual facts or experiences.

This article is not intended to restrict the right to freedom of expression, but aims to protect BOSS and its partners against reputational damage, malicious communication or manifestly unreasonable behaviour, in particular where such statements originate from persons who obtain benefits, prizes or visibility within the BOSS framework.

In the event of a breach of this article, BOSS reserves the right to take appropriate measures, including but not limited to issuing warnings, suspending participation, excluding the participant from future events and applying Article 4.7.

4.7 Prizes, bankrolls and conditional allocation

Prizes, tickets, bankrolls and other benefits awarded within the framework of the Benelux Online Super Series (hereinafter collectively referred to as the “Benefits”) do not constitute unconditional or vested rights, but are granted on a conditional basis, subject to these General Terms and Conditions.

In particular, the following principles apply to bankrolls and similar benefits:

Conditional nature

A bankroll is granted subject to suspensive and resolutory conditions. This means that the retention and continued availability of the bankroll depend on compliance with these General Terms and Conditions, including Article 4.6.

Suspension or refusal of payment

BOSS reserves the right to suspend or refuse, in whole or in part, the allocation or payment of a bankroll or other benefit if:

  • the participant violates these General Terms and Conditions;

    1. reputationally damaging behaviour or communication is identified;

    2. the participant publicly expresses negative, misleading or harmful statements about BOSS, its partners or its events.

Withdrawal of allocated benefits

If a bankroll has already been allocated, in whole or in part, but has not yet been fully used, BOSS reserves the right to withdraw such bankroll in whole or in part if the participant subsequently acts in violation of these General Terms and Conditions. This also applies where the breach occurs after the prize has been obtained.

Non-payment of remaining amounts

In the event of withdrawal or sanction, any remaining, unused or not yet released portions of a bankroll may be permanently forfeited, without giving rise to any right to compensation or indemnification.

Discretionary assessment

The assessment of whether a breach, reputational damage or incompatible behaviour has occurred shall be carried out by BOSS in an autonomous and reasonable manner, taking into account the specific circumstances. BOSS’s decision in this respect shall be binding.

By participating in BOSS events and/or accepting any Benefits, the participant expressly acknowledges that BOSS is entitled to apply the measures described above and that no claim may be made with regard to the retention, payment or compensation of the relevant Benefit.

5. External Links

The BOSS website or the social media platforms on which BOSS is active may contain links to external sites. Pokahnights does not endorse or accept any liability for the content of those sites.

The BOSS Orbit on Days of Poker may also contain links to external websites. BOSS does not endorse or accept any responsibility for their content.

6. Final Provisions

6.1 Use by Minors or Excluded Persons

BOSS events are only accessible to persons who are at least 21 years old and not excluded from participating in gambling activities. Minors or excluded individuals are under no circumstances permitted to enter our physical venues (Pokahrooms or other locations) or participate in online events.

BOSS aims to comply fully with legal requirements and to foster a safe and responsible environment for all members. Therefore, we reserve the right to verify a user’s identity and age at any time. To ensure a smooth and accurate verification process, all BOSS users must have a verified Days of Poker account. Additional ID and age checks may occur at physical locations (Pokahrooms or elsewhere).

If a participant is found to be underage, access will be immediately denied or revoked. In case of doubt, access may be temporarily suspended until age is confirmed. Persons denied access are not entitled to any winnings from BOSS-organized poker activities. Buy-in fees will not be refunded.

6.2 Privacy Policy

Following the BOSS Orbit is subject to our applicable Privacy Policy, which explains how we collect, use, and protect your personal data.

6.3 Applicable Law and Jurisdiction

These Terms are governed by Belgian law. Any disputes shall be exclusively settled by the courts of Antwerp.

6.4 Changes to the Terms and Conditions

BOSS may update these Terms and Conditions. Major changes will be communicated through the Days of Poker platform or by email. Continued use of the platform implies your acceptance of the updated terms. We advise all BOSS Orbit followers to review the documents in the “documents” section regularly to stay informed of any updates.
